Debt Collectors Who Will Sue You

Last March , Chris Hansen of Dateline NBC reported on the what
goes on in the debt collection industry.
Any reader of this blog should definitely
invest the time and watch this expose.

Most of us are familiar with the the term “The Perfect Storm”. While

doing some legal research last week I tripped over a list of those

collection agencies who are filing thousands of law suits against consumers .

In many cases the debts they are attempting to collect are well beyond

what is legally still collectible in the states where these people live.

Presently there are well over 160,000 of  these lawsuits clogging

court dockets throughout the country.

Here is the list I have researched. If you receive a letter

from any of these parties you should get ready for battle or better

yet please go here and take the first step towards reclaiming your life.

  • We are currently taking Brachfeld & Associates aka Meridian Management Solutions to task for their violation of the FDCA and have filed a lawsuit in San Luis Obispo Superior Court. We’d be glad to review any other ‘victim’s’ case to see if we can help them as well. These truly are some of the worst of the worst bottom feeders.   • After finding my ex-wife in tears several times after threathing phone calls from the agency Fredrick, Goldstein & Zoe I talked to them to take care of the problem for her. I was rudely spoken to and also threatened and then hung up on. I finially spoke to Mr. Goldstein , who offered no excuse for the calls but was talked to as a person. My ex has parkensons, on 02, bedfast, awaiting surgery and scarred to death of the threatening calls.

    I made a deal and when I found our I was not credited for a $50 payment tried for 4 days to contact the office. No REPONSE. I finially called my bank who researched the firm and took over the complaint after going to GOOGLE and reading about how the firm was not conducting their business in good faith. They told me it sounded like fraud and told me what to to do, which was to turn it over to them. They said don’t be surprised if I got a call the next day, which I did and when I told of the mistake in what they were takintg out of my bank account was I feel lied to.

    I really don’t know what to do. The amount they said she owed was way over what she actually crarged, I believe she said she only used the card 1 or 2 times for small amounts and never used it again when she began to get outragious penalties. She requested a detailed account but was never given one – just made to cry, I honestly tried to make it right but I was also cheated. I am following what my bank said to do and turned it over to them.

    How can a company get away with that kind of actions? What else can I do – and they did actually make her physical condition worse and has her scarred to death and as I stated – she is 73 years old and very ill. I just don’t understand why when you try to do the right thing with them they still are not honest. I am disabled myself with an incurable bone desease along with complications but was still willing to do what I thought was right.

    I am also a minister and I am praying that they change how the act and treat people right. There is a general Law of the Universe that evens out a persons dishonest actions and you do not know how it will occur but in some area it will even out the actions. Don’t mean to preach but right is right and wrong is wrong.

    I have also recieved calls from Frederick, Goldstein and Zoe. They have called my ex husband and his mother and threated them with having me arrested, papers to be delivered at their work and lawsuits. I contacted them and requested an address to send a letter and they refused to give me an address, e-mail and then were rude to me. How can I find out an address to send a certified letter if they refuse to give me one? I called them back after they hung up on me and still could not get a supervisor. They are calling ex-relatives and I never had the bill that they referenced. Now they are calling my work and threatening my employees who answer the phone.

    Basically these people who don’t really know who they are calling are the lowest form of human filth. They don’t really care that they are breaking the law since the collection industry is raking in hundreds of millions of dollars a year. The fines for each violation of the FDCPA are only $1000.00 per offense so they are not too worried. What you need to do is to send them a cease and desist letter by certified mail. It is one of the 6 letters I offer in my system along with the manual,CD and DVD of my workshop. Again, it is a clear violation of the FDCPA for a debt collector to call neighbors, fellow employees, and relatives of debtor. You can sue under the statute if you can prove these violations. I suggest you procure an attorney from the National Association of Consumer Advocates.

    Thomas wrote above the similar situation for myself as well. However this company called a distant family member through marriage who lives about 6 states away from me. I have found that these companies track down outsiders. This is truly upsetting! How do they have a right to contact “possible relatives”? Then they are rude and will not give details – as Thomas stated – making it appear as though we have done something serious wrong or against the law!

    Hello,
    My mom just got a call from a debt collector (I assume) who represented himself as Lawyer more specifically a partner with the law firm of Fredrick and Goldstien. He gave my mom a case # and said that I was to appear in court in 10 days. A few months ago my mom received a similar call from a law firm of Noble and Graham and was fed a similar lie. Something along the lines of I was going to jail because I had committed fraud (which I found ironic). Both callers were pretty rude to my mother and scared her into thinking that I had done something really wrong. I assume it is in regard to very old credit card that is about to come off of my credit. I am more concerned with them harassing my mom then anything else at this point and would like to stop them from threatening me through her.

    What should I do? Sorry for the long e-mail…

  • Hi Trish,
    They can sue you but it sounds like they are in violation of the FDCPA.
    The court does not know that until you tell them if you are sued.
    Since you debt is past the SOL in your state you should send them
    a certified letter demanding validation and informing them that if they
    persist you will bring a legal action against them under the FDCPA.
    I have never heard of them but they may be a sub contractor for one of
    the major debt buyers of debts that are beyond the SOL. You should Cc:
    the Attorney General of you State and the Regional Office of the Federal
    Trade Commission.

    Don’t be too worried. If they do really sue, file an appearance and answer
    that debt is time barred for FCRA purposes and that you cannot be sued
    because it is beyond the SOL in your state….The judge will get it…..

    Can a collector that I have assured I don’t owe any money trying to collect a debt that is 5 years past my state’s statute of limitations take me to court? They are refusing to mail me anything and won’t give me their address, which I can’t find anywhere online. In fact, I have zero proof that this company exists except that they’re claiming I owe them money within 3-5 business days or they’re taking me to court. Do you know anything about Frederick, Goldstein, and Zoe?
