It’s Someone Else’s Problem Or Is It?

Within the last several weeks someone I know very well came to me or rather called me and said that they received a payment demand from Palisades Acquisitions aka Palisades Collections aka Asta Funding. The demand was on an old Providian account (Providian was acquired by Countrywide). This person absolutely did not have any records regarding the account number on which they were demanding payment.

Their only recollection was that any previous Providian account that they had in the past had been paid off in full.

She asked me if I knew who these parties were. When I saw the names on the letter my  first comment was that I sure did know who they were and that their claim to fame was that they liked to sue people on out of statute debts, on in correct information and debts that could not be validated under Federal Trade Commission or FDCPA guidelines.

My advice was that under no circumstances should their letter and demand be ignored. Unfortunately this is what many people do either out of ignorance, denial or just plain fear. Bad move. Very bad move. I gave her the same Debt Validation Letter that I offer you for free on this site and explained how it should be used.

Asta Funding (Palisades Acquistions) is very clever. They have NCO do their debt collecting for them make what they are perpetrating appear to be official, ethical etc. I must admit it fools lots of people. Then again NCO does n0t have the best reputation either. Just check out BudHibbs.

Let me be clear about one thing even though I have said it many times in many blogs. These collection folks are not your salt of the earth kind of people. They know before they mail you letters that debt the that they are writing about is too old to sue you on but they do legally have the right to try to collect it even though they paid next to nothing to buy it.

The deal is that you must know the statutes that govern their behavior and how to proceed if they try to sue you which in many cases you can count on. If legal counsel is required just any attorney will not cut it.

If you find yourself in too deep and allowed one of these debt collectors to file a suit against you because you did not challenge the debt and let them know that you knew they were in violation of the FDCPA or the FCRA, you will need a lawyer who specializes in consumer law. Hopefully this does not happen to you. Your best weapon is to read what is in my user’s manual that comes with my system. Knowledge is strength.
