A common ploy which is at the least deceptive and at the worst a violation of the FCRA (Fair Credit Reporting Act) is for buyers of old or junk debt to attempt to restart the clock on the statute of limitations by reporting “new activiity” on your credit report when in fact they know very well they are barred from doing so by the FCRA. The date of last activity would technically be the date of your last payment or the date that the original creditor charged off the account. You can inform the credit bureaus of the reporting violation by certified mail which should suffice. I have seen new entries by the 3rd buyers of accounts inserted into credit reports stating the account was put into collection. Never mind the fact that the debt was beyond the statute of limitations in the state for which the debtor lived and that the subject buyer could not validate the debt.

The debt predator produced a fraudulent affidavit signed by its own employee attesting to the fact that she had possession of the account’s documents but failed to produce them but did provide 3 bills of sale in which the debtor’s name of account never appeared. Very compelling and convincing I might add!!
