You Just Never Know Who May Need Your Help

Most of you have heard about Twitter, Facebook, and Linkedin. These are termed social networks. Today I learned the term “affinity network”. An affinity network is a closed network; could be your company, your grammar school or high school class. Well my high school class has its own website and this is an affinity network. Because of this ability to bring a lot of people who I went to high school with together, I received a call today from one of my high school classmates.

Because of biographical material on our class website she knew of StoptheCallsFast.Com. Turns out that her husband is being harassed by a predatory law firm that specializes in buying up old debt and suing people who will not pay them. She put her husband on the phone and I asked him the name of the law firm. Thanks to BudHibbs.Com and the excellent data he keeps on bottom feeders I was able to give my classmate’s husband the low down on these people.

Lucky for him that I was able to give him some factual data. They had already filed a suit against him some days ago. I asked him some more questions and discovered that the subject debt had never been validated by the plaintiff. I rant and rave about validation all the time so you know what I am talking about. I explained how these guys play the game to him. Basically that file suit in the hope that you will not answer the complaint or show up in court.  They get the default judgment and then put a lien 0n your property or attempt garnishment if you are on salary. I explained to him that he must appear and also file a written answer to the court and to the plaintiff. I also told him to immediately demand validation of the debt.

I explained that the odds are  that they would come to court unprepared believing that he is going to be a no show. I further told him that a lot of the time they just have any attorney who they pay per docket # just to say that the plaintiff is present because most of the time the defendant is not.

I suggested that he pay a visit to the subject courthouse some days before the hearing to get the lay of the land so to speak so that he would not feel in any way intimidated on the day his appearance. I told him to simply tell the court that he does not acknowledge the subject debt and that the plaintiff had failed to validate the debt. I said this is a must since the court will not know that the plaintiff is trying to pull a fast one unless you tell them. Let us just say he feels a lot better after talking with me.

I guess the bottom line here is what I am always preaching. You may not have a problem with debt collection but someone you know often does.
